2. Applicability
By placing an order through the GEMYENA website, you agree to these Terms of Sale, our Refund Policy, our Shipping Policy, our Terms of Service, and our Privacy Policy.
These Terms of Sale apply to purchases made by customers in the United States.
Nothing in these Terms of Sale is intended to exclude, restrict, or waive any consumer rights or remedies that cannot lawfully be excluded or limited under applicable law.
3. Products
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications, colors, and other product information displayed on our website are accurate and up to date.
Product colors and appearance may vary depending on your device, display settings, lighting conditions, and other factors.
We do not guarantee that the appearance of a product on your device will exactly match the physical product.
Product descriptions, specifications, pricing, and availability may be updated from time to time.
4. Product Availability
All products are subject to availability.
We make reasonable efforts to maintain accurate product availability information.
If a product becomes unavailable after an order has been placed, GEMYENA will contact the customer and may offer an appropriate alternative or cancel the affected order and issue a refund to the original payment method.
Any alternative solution, including store credit, will only be provided with the customer's consent.
5. Orders
When you submit an order through our website, you are requesting to purchase the selected products at the displayed price and under these Terms of Sale.
An order is accepted when GEMYENA confirms the order and successfully processes payment.
We reserve the right to decline or cancel an order where permitted by applicable law, including in cases involving suspected fraud or unauthorized activity, payment problems, product availability issues, pricing or product information errors, or misuse of promotional offers.
If we cancel an order after payment has been processed, the amount paid for the canceled order will be refunded to the original payment method.
6. Pricing and Taxes
All prices are displayed in U.S. dollars unless otherwise stated.
Prices, discounts, promotions, and product availability may change from time to time.
The price charged for an order will be the price displayed at the time the order is submitted and confirmed, except in cases of an obvious pricing or product information error.
Applicable sales taxes will be calculated and displayed at checkout based on the customer's shipping address and applicable law.
7. Payment
Payments are processed securely through Shopify and/or authorized third-party payment providers.
By placing an order, you confirm that you are authorized to use the payment method provided.
You agree to provide accurate and complete billing and payment information necessary to process your order.
GEMYENA does not intentionally store complete payment card information on its own systems where such information is processed by authorized payment providers.
8. Shipping and Delivery
GEMYENA currently ships within the United States only.
We currently do not offer international shipping.
Standard shipping is free on all U.S. orders.
Orders are normally processed within 0–1 business day after payment has been successfully received.
Orders are processed and shipped Monday through Saturday, excluding applicable holidays and days when our fulfillment operations are closed.
Once an order has been processed and shipped, standard transit time is estimated at 5–11 business days.
The estimated total delivery timeframe is therefore approximately 5–12 business days from the date the order is placed.
Delivery times are estimates and are not guaranteed. Delivery may take longer due to carrier operations, weather, holidays, peak periods, incorrect or incomplete address information, or other circumstances outside our reasonable control.
If we become aware of a significant shipping delay, we will provide appropriate information when available.

9. Returns and Refunds
Eligible purchases may be returned within 30 days of delivery, subject to the conditions set out in our Refund Policy.
Our Refund Policy explains the applicable return period, eligibility requirements, return shipping costs, defective or incorrect products, non-returnable products, cancellations, and refund procedures.
For standard returns, including returns due to a change of mind, incorrect size, or personal preference, return shipping costs are the responsibility of the customer unless otherwise stated in our Refund Policy or required by applicable law.
If an item is defective, damaged due to an issue attributable to GEMYENA, or incorrectly shipped, GEMYENA will provide appropriate return instructions and cover applicable return shipping costs in accordance with our Refund Policy.
Direct exchanges are not currently offered. Customers who would like a different product, size, color, or style may return the original product in accordance with our Refund Policy and place a new order.
Approved refunds are issued to the original payment method used for the purchase.
10. Order Cancellations
Customers may request cancellation of an order before it has been shipped by contacting:

Once an order has shipped, cancellation may no longer be possible and the order will instead be subject to our Refund Policy.
11. Promotions and Discounts
Promotional offers, discounts, sales, bundles, and other special offers may be subject to specific terms and conditions displayed with the applicable offer.
Where specific promotional terms conflict with these Terms of Sale, the specific promotional terms will apply to the extent of the conflict.
Unless otherwise stated, promotional offers cannot be combined.
GEMYENA reserves the right to correct obvious pricing, promotional, or technical errors and to cancel affected orders where permitted by applicable law.
12. Errors and Corrections
We make reasonable efforts to ensure that information displayed on our website is accurate.
However, occasional errors may occur, including errors relating to product descriptions, pricing, promotions, availability, or other website content.
We reserve the right to correct errors and update website information when necessary.
If an order is affected by a material error, GEMYENA may contact the customer to offer an appropriate resolution or cancel the affected order and issue a refund to the original payment method.
13. Consumer Rights
Nothing in these Terms of Sale is intended to exclude, restrict, or waive any consumer rights, warranties, remedies, or protections that cannot lawfully be excluded or limited under applicable federal or state law.
Where mandatory consumer protection laws provide greater rights or protections than those described in these Terms of Sale or our policies, those rights and protections will apply.
14. Governing Law
These Terms of Sale shall be governed by and construed in accordance with the laws of the State of Delaware and applicable federal law, without regard to conflict-of-law principles.
Nothing in this section limits any mandatory consumer protection rights or remedies available under the laws applicable to the customer.
To the extent permitted by applicable law, disputes arising from these Terms of Sale or purchases made through the GEMYENA website may be brought before the appropriate state or federal courts located in Delaware.
